By accessing or using the ProTradesFinder platform, website, or mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

ProTradesFinder ("we", "our", or "us") reserves the right to modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to disable your account if we determine, in our sole discretion, that you have violated these Terms.

4. User Types and Subscriptions

4.1 Customer Accounts

Customer accounts are free to create and use. Customers can create video requests, connect with tradespeople, schedule appointments, and use our AI-powered assistance without charge.

4.2 Tradesperson Accounts

Tradesperson accounts require a subscription. The current subscription fee is £4.99 per month. Subscription fees are subject to change with notice to users.

Subscriptions are billed on a recurring basis. You can cancel your subscription at any time, and your access will continue until the end of your billing period.

5. User Content

The Service allows you to upload, post, and share content, including videos, images, and text ("User Content"). You retain all rights in your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with providing and promoting the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate the rights of any third party
• Your User Content complies with these Terms and all applicable laws

We reserve the right to remove any User Content that violates these Terms or that we find objectionable for any reason.

6. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Violate any laws or regulations
• Impersonate any person or entity
• Harass, abuse, or harm another person
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to the Service
• Use the Service to transmit malware or other harmful code
• Collect or harvest user data without permission
• Use the Service for spamming or advertising
• Engage in any activity that could damage, disable, or impair the Service

7. Payments and Refunds

All payments are processed through our third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method.

Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy. We offer a 30-day money-back guarantee for tradesperson subscriptions if you are not satisfied with the service.

8. Termination

We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

Upon termination, your right to use the Service will immediately cease, but all provisions of these Terms that by their nature should survive termination shall survive.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
• ANY CONTENT OBTAINED FROM THE SERVICE
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless ProTradesFinder and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
